The move left participants befuddled and not a little concerned about the implications for the asset intensive reinsurance (AIR) market.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c769ccf elementor-widget elementor-widget-text-editor\" data-id=\"4c769ccf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cIt definitely caught the industry by surprise,\u201d notes one industry observer. \u201cThere was no public exposure of that before they put it out. It got a lot of discussion in the hallways at the NAIC meeting a couple weeks ago, and it is going to be a fairly controversial issue.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-687e1122 elementor-widget elementor-widget-text-editor\" data-id=\"687e1122\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>So what drove the decision? All the evidence points towards the Cayman Islands.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99d9ce5 elementor-widget elementor-widget-heading\" data-id=\"99d9ce5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Cayman and Life Reinsurance<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1368f81e elementor-widget elementor-widget-text-editor\" data-id=\"1368f81e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The NAIC\u2019s proposals stem from the early findings of AG 55, an initiative introduced last year to bring transparency to the AIR market. Regulators had sifted through some 150 reinsurance transactions executed since 2019 and discovered aggressive cashflow testing assumptions, particularly regarding asset returns.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55094ccd elementor-widget elementor-widget-text-editor\" data-id=\"55094ccd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Crucially, the NAIC identified these practices in non-reciprocal jurisdictions\u2014a category where the Cayman Islands has been the fastest-growing player.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1fdbc452 elementor-widget elementor-widget-text-editor\" data-id=\"1fdbc452\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>At year-end 2025, total reinsurance assets in the Cayman Islands reached $101 billion, more than quadrupling from $23 billion in 2020, according to data from the local financial regulator, the Cayman Islands Monetary Authority (CIMA).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-72b8047 elementor-widget elementor-widget-text-editor\" data-id=\"72b8047\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The territory has aggressively positioned itself as a premier reinsurance hub, sending sizeable delegations to industry gatherings and talking up its advantages&#8211;which might include regulatory flexibility and its tax-haven status&#8211; as it seeks to gain traction in the global life-re market.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1fb2549c elementor-widget elementor-widget-text-editor\" data-id=\"1fb2549c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Momentum peaked in August, when the Cayman government sent a delegation to the US to announce it was launching its application for US QJ status.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46a7447 elementor-widget elementor-widget-text-editor\" data-id=\"46a7447\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cWe, as an industry, have been excited about this for the last two years or so,\u201d says one Caymanian representative who asked not to be identified. \u201cWe&#8217;ve been looking forward to it, and so the fact that it is in is a huge momentum boost for us.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78e5c36 elementor-widget elementor-widget-text-editor\" data-id=\"78e5c36\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>QJ status is needed because, despite its goodwill push, the Cayman Islands has struggled to keep its head above water in the increasingly-competitive life reinsurance market.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46c798ec elementor-widget elementor-widget-heading\" data-id=\"46c798ec\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Attacks and Industry Friction<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5db6d102 elementor-widget elementor-widget-text-editor\" data-id=\"5db6d102\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The last few years have seen Cayman become something of a whipping boy for international reinsurers\u2014particularly those in Bermuda, keen to maintain the status quo. Athene, leader of the new breed of private equity-insurers, has been one of the more vocal in its criticisms.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b1b3e70 elementor-widget elementor-widget-text-editor\" data-id=\"b1b3e70\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cWe&#8217;re seeing contagion risk right in front of our eyes in the Cayman Islands,&#8221; John Golden, Partner and Global Head of Financial Regulation at the insurer, said in a webcast in July. &#8220;All you have to do is compare the Cayman Islands supervisory regime to the US or Bermuda across the major things that matter\u2014solvency, transparency, governance, risk management, these types of fundamental regulatory policies. You&#8217;re seeing less in each one of those categories, and sometimes drastically less depending on the company and the situation.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6885bb1e elementor-widget elementor-widget-text-editor\" data-id=\"6885bb1e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>There are many holes for the Cayman Islands to fill, it seems. In conversations with participants, Life-Re was told of an opaque regulatory framework reliant on a confused choice of capital models, backed by insufficient resources required to oversee the complexities of the AIR business. US regulators appear especially concerned by the poor regulatory dialogue with Cayman regulators, which contrasts with the rigorous exchanges standard with Bermuda. Cayman-proponents reject this.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-770a0345 elementor-widget elementor-widget-text-editor\" data-id=\"770a0345\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cThe people that need transparency have the transparency,\u201d says one Cayman life participant who asked to remain anonymous. \u201cThe regulators, the rating agencies, the cedants, the onshore regulators\u2014if they want information, they can have it. Just because it&#8217;s not published online and freely available doesn&#8217;t mean that the regulation doesn&#8217;t happen.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2b89ee45 elementor-widget elementor-widget-text-editor\" data-id=\"2b89ee45\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Participants also question whether a regulatory body of CIMA\u2019s scale can maintain the specialized supervisory staff required to audit diverse global accounting regimes simultaneously. The point was highlighted in August, when CIMA\u2019s head of insurance supervision, Kara Ebanks, departed to join a private insurer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76258b37 elementor-widget elementor-widget-text-editor\" data-id=\"76258b37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>On top of all this is the lingering suspicion around Cayman\u2019s \u201cflexible\u201d approach to accounting treatment and capital modelling. While Cayman supporters argue the modelling and accounting customisability acts as a &#8220;secret sauce&#8221; for bespoke risk profiles that rules-based systems fail to address, critics view it as a systemic vulnerability.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-775c6d43 elementor-widget elementor-widget-text-editor\" data-id=\"775c6d43\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>As an example, the jurisdiction allows reinsurers to pair US Generally Accepted Accounting Principles (GAAP) or international financial reporting standards with US Risk-Based Capital (RBC) factors which some believe has the potential to create a fundamental mathematical mismatch.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5480fe95 elementor-widget elementor-widget-text-editor\" data-id=\"5480fe95\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Again, propents disagree.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3b2f1e9 elementor-widget elementor-widget-text-editor\" data-id=\"3b2f1e9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>\u201cIt&#8217;s really not a choose-your-own-adventure structure,\u201d according to one Cayman player, speaking anonymously. \u201cIt is choose from a set of established frameworks that are known to work across other jurisdictions, and those frameworks are typically US-based or similar to Bermuda. I think with enough time, the US regulators will be able to wrap their head around some of the idiosyncrasies.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c11e059 elementor-widget elementor-widget-text-editor\" data-id=\"c11e059\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The NAIC\u2019s recapture charge proposals suggest it does not feel quite in that space for now.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5c969508 elementor-widget elementor-widget-heading\" data-id=\"5c969508\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The Cayman view<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-70ac4d6 elementor-widget elementor-widget-text-editor\" data-id=\"70ac4d6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>One cannot help but have some sympathy with the Cayman Islands. The small Caribbean jurisdiction is aiming to grow its life reinsurance market and catch its more established counterpart, Bermuda. Doing so was never going to be easy given the significant revenues this business is currently bringing in\u2014and the latest announcement makes things even more challenging. While things are still at an early stage, an NAIC refusal would present a formidable barrier to the Cayman Islands\u2019 goal of operating on equal footing with reciprocal jurisdictions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-76363255 elementor-widget elementor-widget-text-editor\" data-id=\"76363255\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Could there still be a way for Cayman to gain QJ status?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-73198c65 elementor-widget elementor-widget-text-editor\" data-id=\"73198c65\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Potentially. Cayman is not required to replicate the US regulatory framework in precise detail. More important is for the framework to demonstrate sufficient transparency and consistency in its oversight. One of the strategies employed to gain trust has been a sequenced effort with the island going for Property &amp; Casualty QJ status first\u2014where it believes its reserving and capital frameworks are long-established\u2014before tackling the life sector. That may increase comfort levels for NAIC rulemakers to soften towards the life business. Or it may not.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-44aae019 elementor-widget elementor-widget-text-editor\" data-id=\"44aae019\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>A rebuffing of QJ status for Cayman\u2019s life business would certainly be a reputational blow for the jurisdiction. However, given it will take at least two years, most likely longer, to decide on, participants remain hopeful that time will enable a full review of the island\u2019s regulatory veracity.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7dd0bf58 elementor-widget elementor-widget-text-editor\" data-id=\"7dd0bf58\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>For now, US regulators are advancing on their capital charge investigations. The fear for many in the market is whether the proposal could eventually extend to other jurisdictions, even the ones with existing QJ status.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5907a855 elementor-widget elementor-widget-text-editor\" data-id=\"5907a855\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>By life reinsurance regulatory standards\u2014which can be a complicated matter at the best of times\u2014this is a tangled web that has been woven.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-161cdaac e-con-full e-flex e-con e-child\" data-id=\"161cdaac\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-12109d5c elementor-widget elementor-widget-heading\" data-id=\"12109d5c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Cayman turns to Japan<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4fea0d79 elementor-widget elementor-widget-text-editor\" data-id=\"4fea0d79\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>A targeted capital charge on non-reciprocal transfers will inevitably pose challenges for Cayman-focused life reinsurers in the US. However, Caymanian market participants are already adjusting their long-term growth trajectories\u2014specifically with a move to Japan. The latter has seen an AIR boom on the back of its recently implemented J-ICS capital regime, and participants predict much more to come.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1bf46499 elementor-widget elementor-widget-text-editor\" data-id=\"1bf46499\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Cayman counterparties have already been pitching their advantages as a destination for Japanese life portfolios. For example, they point to the $853 billion of Japanese portfolio assets already located in Cayman, which accounts for more than 60% of Japan\u2019s overseas investment fund holdings. That, they say, should mean an increased familiarity with the jurisdiction and its ways of doing business. Whether Japanese insurers are as aware of Cayman\u2019s prospective advantages remains to be seen.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>In August, the NAIC came out with surprise news that it was considering a capital charge for the life reinsurance market.
